Riley County officials are working to prepare a new fireworks resolution to replace the county’s existing regulations following a change in state law. At Monday’s meeting, the county counselor and emergency management director proposed an updated resolution that would extend the sale of fireworks by a couple of days and increase the fee for a fireworks’ sales permit.

The regulations the county currently has in place are from 1978.

Senate Bill 199 allows for the year-round sale of fireworks for permanent retailers and extends the sale of fireworks for seasonal retailers from June 20 to July 7 for seasonal vendors. However, counties retain their authority to regulate when fireworks are sold and discharged/fired. The law came into effect April 24.

A version of Senate Bill 199, regarding the statewide sale of fireworks passed by both house and senate. The bill passed in the senate on Feb. 19 and passed in the house on March 18. This bill will allow permanent retailers to sell fireworks year-round and for temporary vendors to sell fireworks from June 20 to July 7, extending its current sale restriction from June 27 to July 5.

“It’s gone before both chambers for a vote and both approved a version of it that seemed to be fairly similar,” Bryant Parker, the county counselor said in Monday’s county commission meeting. “I believe I heard from (fire chief Russel) Stukey that there’s a thought we would still have some local regulatory power. As I read the statute, I don’t know.”

Parker said the Kansas Association of Counties and the League of Kansas Municipalities may give statements about this soon which Riley County can base guidance on.
