The Pottawatomie County Commission’s decision to approve a conditional use permit for a rock quarry in the north-central part of the county was affirmed Friday by the Kansas Court of Appeals.

The quarry sits on a portion of an 853-acre plot, just over one and a half miles south of Wheaton. Mid-States Materials is requesting a permit for a rock quarry on six tracts of land approximately a half mile west of Wheaton Road. The tract sits inside a boundary created by Reves Road, Belleville Road and Clear Creek Road.

Mid-States Materials is part of the Topeka-based Bettis Asphalt company.

The Kansas Court of Appeals receives a new bench member Wednesday, with the swearing in of Judge Lori Bolton Fleming.

Fleming graduated from Washburn University School of Law in 2001, after an initial career in education. She attributes her value of communication to her experience as an educator.

“I believe that our government belongs to the people, and as judges it is important that we communicate what we do and why we do it directly to the people we serve.” said Fleming.
