A trial for a man charged with rape and two counts of aggravated sexual battery started Friday in Riley County District Court.

Joshue Sandoval Serrano, 23, was arrested in 2024 for his alleged crimes. He has maintained a plea of innocence. The trial started Friday with jury selection and is scheduled to go through Thursday.

The prosecution stated in a complaint filed with the court that on Oct. 28, 2023, Sandoval Serrano engaged in sexual intercourse with a woman while she was “incapable of giving consent due to the effect of alcohol.” The document alleges the counts of aggravated sexual battery come from the same incident with the same victim. Prosecutors said he was aware of the woman’s condition.

Officers filed a report of criminal destruction of property on January 9, 2025, at approximately 12:08 PM in the 1300 block of Pillsbury Drive.  Officers list the victim as Affordable Towing when it was reported an unknown suspect damaged their metal fence. Total loss associated with this report is approximately $5,000. Anyone with information can contact Crime Stoppers. Using Crime Stoppers allows you to remain anonymous and could qualify you for a cash reward of up to $1,000.

Abel Gutierrez, Jr., 34, of Laredo, Texas, was arrested on January 9, 2025, at approximately 1:00 PM in the 1000 block of S. Seth Child Road.  Gutierrez was arrested on a Riley County District Court warrant for aggravated sexual battery (victim is physically powerless), failure to appear, aggravated sexual battery (force or fear), and sexual battery x2. Total bond was set at $15,500. Gutierrez was confined at the time of this report.
